Let's Cease and Desist from Freedom of Speech...
Apparently our School District has seen fit to waste Eastchester taxpayers' money by hiring lawyers
to harass the CARE organization. A Cease and Desist Notice was received by the CARE
organization and Renee Marsh as the registered domain owner for the CARE website. To read the
full text of the notice click here.
In short, they "demanded" that we cease and desist from using the domain name
eastchesterschools.org. Their position is that our intent is to mislead the public. If we did not
comply, the District would "avail itself of all remedies avaliable to it."
Pointing out that the claims are absolutely baseless is too easy for words. But let's try a few...
1. Our domain name of eastchesterschools.org was not deceptive nor was it intended to be. It
represented our group's concern and interest. The domain name is generic as there are many
"schools" in Eastchester - including private and parochial. The domain name in no way, shape or
form used the legal name of the district nor does it look anything like the Eastchester Union Free
School District web site at http://www.eastchester.k12.ny.us/
2. The statute cited in NYS General Business law covers deceptive trade practices. We are not a
business nor is the Eastchester Union Free School District (EUFSD). And what about
eastchesterschools.com? Is the District pursuing them too? If not, why not?
3. Where are all the confused parents and complaints? Please let us know if in any way you or
anyone you know was duped when you got to a website that said CARE and had a prominent
mission statement. For anyone who would like a Google test.... try searching on Eastchester
Schools. What comes up on top? The EUFSD.
Bottom line, this is a blatant attempt to stifle our first amendment right of free speech and silence
any opposing views. It is an abuse of power, position and the legal system.
But let's face it... they have one thing we do not... money... OUR money.
The money to pay Keane and Beane is not coming out of the pockets of the School Superintendent
or the School Board - it is coming out of the Eastchester taxpayers' pockets. Suprising how the
District can do this with such a lean budget...yep, could not have trimmed another dime..
Honestly, we would rather not pick your pocket... that is if there is anything left after you pay your
school taxes. The District may be willing to waste our tax dollars on a frivolous legal battle but we are
not.
So join us at eastchestereducation.org as we continue our efforts to bring transparency and
accountability to the District.
Please sign our guest book, as we lost our previous one when we moved.
